Booking conditions General These booking conditions have been formulated as a result of our responsibilities under law. They do not affect your statutory rights. All bookings are made and accepted subject to the terms set out in these conditions and the information detailed on our website. The person in whose name the booking is made acts on behalf of all other persons named, must be over 18 years of age and becomes responsible to us for all payments in respect of the booking. All guests who stay at the villa must be on the guest list which must be provided at least 14 days prior to departure. We require the names of all Individual guests who will be staying at the villa. The total number of guests staying at the villa at any one time must not exceed the maximum number below. This is a fire regulation over which we have no control. Yesiloz Villa maximum number of guests is 17 Nesrin Villa maximum number of guests is 13 Sultan Villa maximum number of guests is 8 Begonia Villa maximum number of guests is 14 Villa Marcus maximum number of guests is 17 Villa Alison maximum number of guests is 17 Villa Olji maximum number of guests is 17 We do not allow one guest to replace another guest who is already staying at the Villa without prior arrangement where this involves the total number of guests on the guests exceeding the total number allowed. We do not allow anyone to visit the villa that is not on your guest list. This is very important as unauthorized guests who are found at the villa will be charged for and maybe asked to leave as well. What we do not want is either for our guests to bring back "friends" who they meet on holiday or friends who they arrange to meet on holiday. We do not allow any guests to stay over and above the total number allowed (see above). This is a fire regulation over which we have no control. Guests who are on the guest list may replace another guest on the list as long as the total number of guests does not exceed the total number of guests allowed at any one time. The normal charge for unauthorized guests not on the guest list is £100 per person per day (minimum charge £100), and they will normally be asked to leave immediately. It is a condition of booking that you have adequate insurance on your holiday. We accept responsibility for the acts and/or omissions of our employees, agents, and suppliers while acting within the scope of, or in the course of their employment with us. We also accept responsibility for any deficiencies in the services we are contractually obliged to provide, or the failure of such services to reach a reasonable standard. We are unable to accept responsibility for any aspect of your holiday affected by matters over which we have no control. These include war or threat of war, riots and civil strife, terrorist activity, natural or nuclear disaster, weather conditions, fire, flood, drought, industrial disputes, government action, airport regulations and closures or technical transportation problems which may affect the scheduling of aircraft or other transport or other circumstances amounting to Force Majeure. We do not accept responsibility in respect of death, bodily injury or illness of any person taking one of our holidays, except when caused by the negligent acts and/or omissions of our employees, agents, suppliers or sub-contractors while acting within the scope of, or in the course of their employment, agency, contract of supply or sub-contractor. We have done our best to ensure that our brochure is accurate at the time of going to press. On occasions, especially during low season, certain facilities or amenities such as water sports, swimming pools, restaurants etc. may not be open or available as advertised due to maintenance, weather conditions, lack of demand or for other reasons outside our control. Any special requests must be advised to us at the time of booking and clearly noted on the booking form. Whilst we will endeavour wherever possible, to meet or pass onto suppliers any reasonable special requests we cannot guarantee that they will be fulfilled. Any failure to meet special requests will not be a breach of contract on our part. If you or any member of your party has any medical condition or disability which may affect your holiday, it is vital that you tell us before you confirm your booking so that we can advise as to the suitability of the chosen accommodation. The requirements and standards of the country you are visiting apply to services provided there and these may be lower than those of the UK. Suppliers providing the services which make up your holiday do so in accordance with their own terms and conditions. Some of these terms and conditions may limit or exclude the supply of liability to you, usually in accordance with International Conventions. You are responsible for any breakages or damages caused by you or any member of your party during your stay in your accommodation. It is your responsibility to either put things right or make full payment to our local representative before your departure. We plan our holidays many months in advance. And though it is unlikely that we will have to make any changes to confirmed bookings, it can happen. Changes are usually of a minor nature, and we will advise at the earliest possible date, if there is time, before your departure. All flight details should be confirmed 4 weeks before date of arrival. This is particularly important as if we are arranging transfers. For the purposes of the conditions the time and date of arrival shall be the date you confirm 2 weeks before. Payments THE PRICE OF STAYING IN OUR VILLAS IS GUARANTEED AND WILL NOT BE SUBJECT TO ANY SURCHARGES. The price shown on your confirmation/invoice is fully guaranteed provided conditions of payment are adhered to. When you make the booking a contract is made, and we will confirm your booking as soon as we receive a completed and signed booking form. With your booking form you must pay the deposit, which is normally 25%, if the booking is within 16 weeks of the departure then full payment is due. An invoice will be sent to for the balance of moneys owing. Your reservation will be confirmed upon payment of a deposit. We usually allow 3 working days for your booking form and monies to reach us. The balance of your holiday cost must be received by us at least 16 weeks before departure date. Please note that you will receive a reminder that final payment is due. Please also ensure you send payment in sufficient time for us to pay-in and clear your payment through your bank, otherwise your booking will be cancelled, and you will be liable to pay cancellation charges as shown below. Day of Arrival and Departure The villa is normally available from 6.00pm on the Sunday. It may be available earlier and this can be arranged in advance and confirmation will only be given in writing. We ask guests to vacate the villa by 12.00 pm on the Sunday and this is to allow the villas to be cleaned. We offer a range of options for guests who want to extend their holiday. This is on our website: http://www.alanya-holidays.comArrivalAndDeparture.htm. Charges do apply. Please note that we do charge guests who remain in the villa after 12.00pm without authorisation. There is a minimum charge of £50.00 which is charged where the villa is still not vacated by 12.30pm. We would still expect the guests to leave immediately to allow the cleaners to make the villa ready for the next guests. Cancellations and Refunds We are unable to accept any liability for any delay to your flight, whether the delay or cancellation is caused by adverse weather conditions, the action of air traffic controllers, the action of airport authorities or governments, the rescheduling of times by the airline, mechanical breakdown, strike or industrial action or otherwise. In such circumstances you may be able to make a claim under your insurance policy problems to transport, closure or disruption of airspace or airports or seaports, cancellation of scheduled airline or sea services, or other events outside our control. We reserve the right, in EXCEPTIONAL circumstances, to ask all the guests on the guest list to leave the Villa. This has never happened and would only be done in the event of behaviour or actions which were completely unacceptable for example illegal use of drugs, wilful damage, where unauthorized guests are found at the villa and violent or dangerous behaviour. Where unauthorized guests are found at the villa and In the event we would not be prepared to refund any money for any part of the booking. We reserve the right, in EXCEPTIONAL circumstance, to cancel your holiday. If due to events beyond our control, we are no longer able to provide the holiday originally booked, we will return your money, or offer you an alternative holiday of a comparable standard. If you wish to change your holiday in any way, and we accept the change, the following charges will apply. Timescales refer to the date of receipt of your instructions in writing. If you wish to cancel your holiday, the person in whose name the holiday is, must inform us in writing and this should be sent to us by Recorded Delivery. In the event of cancellation or part cancellation, the following charges become payable: Less than 16 weeks BEFORE DEPARTURE No refund will be payable More than 16 weeks BEFORE DEPARTURE Any monies paid in excess of 25% 25% booking deposit is non refundable Security deposit Refund The security deposit will normally be refunded within 2 weeks of your return. Please contact us as soon as you return home. You will normally be advised of the cost of Electric, Gas and phone before you leave the villa, in addition any outstanding claims for damage, loss or breakage or extra services such as our pampering services with be subtracted from the security deposit. Nesrin will normally discuss all these matters with you on the last day at the villa. Where the amount payable exceeds the deposit then payment must be made in Turkey, this must be paid in cash as please note that we do not accept Credit/Debit card payment in Turkey. Complaints procedure We very rarely have a problem and all so far have been very minor. However it is important that our guests know that we will treat their complaint quickly, fairly and professionally. All guests are given a questionnaire on arrival which we normally collect on the following day, guests are also given a questionnaire on their day of departure, guests are also free to fill in any time the complaints form that is left at the villa in the information folder. If a problem arises during your holiday, it is essential that you advise us at the earliest opportunity, and we will endeavour to put things right. We take complaints very seriously and we try to put things right because we want our guests to return as guests and recommend us to their family and friends. If you are unhappy with the response/action taken locally in Turkey then guests must immediately contact David Gilmartin ( 07973 227415) . If your complaint cannot be resolved locally, our representative in Turkey will ask you to complete a report form, the original of which is for you and a copy will be forwarded to us The complaint must be followed up by writing to us using recorded delivery, within 7 days of leaving the villa.
